The short version: NewTunes ZA is free, for listeners and artists. Listen as much as you like. If you upload music, it must be yours to share: you keep owning it, and you let us stream it to listeners until you delete it. Be respectful, and don't upload anything that isn't yours.
These terms are the agreement between you and Hybrid Learning Solutions (Pty) Ltd ("we", "us"), which runs NewTunes ZA: the Android app and the web player at newtunes.co.za. By using NewTunes ZA you agree to these terms. If you don't agree, please don't use it.
The service
- NewTunes ZA is a place to discover and play music by South African artists.
- It's free. There are no ads, no subscriptions and no in-app purchases.
- You can listen, like and follow without an account. Publishing music needs an account.
- Music is streamed in the app. NewTunes ZA doesn't sell or offer downloads of songs.
Your account
- Give a real email address, keep your password private, and don't share your account. You're responsible for what's done with it.
- If you're under 18, you need a parent or guardian's permission to create an account or upload music. NewTunes ZA is not aimed at children under 13.
- You can delete your account in the app at any time. See how to delete your account.
Publishing your music
- You keep ownership. Your songs, cover art, photo and profile stay yours.
- Only upload what you have the right to share. That means music you wrote and recorded yourself, or have permission to publish from everyone who owns a part of it: co-writers, band members, producers, labels, and the owners of any samples or beats you used. You confirm this every time you upload.
- The licence you give us. By uploading, you give us a free, non-exclusive permission to store your songs and images, stream them to anyone using NewTunes ZA, and show your profile, artwork and song details in the app and on our website and social media to promote you and NewTunes ZA. This permission ends for a song when you delete it, except for copies already in backups, which are removed over time.
- Everything you publish is public. Anyone can see and play it, so only share what you're happy for everyone to hear.
- NewTunes ZA doesn't pay artists or collect royalties for you. Uploading here doesn't stop you from publishing your music anywhere else.
What's not allowed
Don't upload, post or do any of the following on NewTunes ZA:
- music, artwork or photos that belong to someone else without their permission;
- content that is hateful, harassing, threatening, sexually explicit involving minors, or that promotes violence or breaks South African law;
- pretending to be another artist or person;
- inflating plays, likes or follows, for example with bots or repeat plays, or trying to get around our bot protection;
- interfering with the service, or trying to access other people's accounts or data.
Reports and removal
- Anyone can report a song in the app. We review reports and may hide or remove content, without notice, if we believe it breaks these terms or the law.
- If you own the rights to music that has been uploaded without your permission, report it in the app or email shepherdmark1968@gmail.com with the song and artist name, what you own, and how to contact you. We'll remove it promptly once we've checked the complaint.
- We may suspend or close accounts that repeatedly or seriously break these terms.
Your privacy
The privacy policy explains what we collect and how we use it.
Changes and availability
- We may update the app, change or remove features, or stop offering NewTunes ZA. If we plan to close it, we'll give artists reasonable notice in the app where we can.
- We may change these terms. If we do, we'll update this page and the date at the top, and for important changes we'll also tell you in the app. If you keep using NewTunes ZA after a change, you accept the updated terms.
No warranty
NewTunes ZA is free and provided "as is". We work to keep it running well, but we can't promise it will always be available or free of errors, or that play, like and follower counts will always be exact. Keep your own copies of your music: NewTunes ZA is not a backup.
Liability
As far as the law allows, we are not liable for any loss that comes from using NewTunes ZA or being unable to use it, or for content that other people upload. Nothing in these terms limits any rights you have under the Consumer Protection Act or other law that can't be excluded.
Governing law
These terms are governed by the laws of the Republic of South Africa.
